Consent, Capacity, and Liability in Emergency Healthcare
Assignment 1
This assignment critically analyzes a complex medical‑legal scenario, focusing on issues of informed consent, patient capacity, emergency care obligations, and provider liability. I evaluated potential claims against each hospital and provider while considering applicable legal defenses, such as emergency exceptions, standard of care, and delegation of care. I also identified how alternative actions, such as clearer consent policies or communication, could have reduced liability. Overall, the assignment demonstrates my ability to apply healthcare law concepts to real‑world situations and assess risk from both patient and provider perspectives.
